LIABILITY RELEASE FOR MOMENTUM MOVING & STORAGE

I. BASIC DAMAGE PROTECTION Momentum Moving & Storage provides basic Released Valuation Coverage on all moves, with a coverage of up to $0.60 per pound for damage to household goods while being handled by the movers. This is a default coverage, but it is not insurance and is not value-based.
 

Our liability for basic damage protection ends once our movers are no longer in possession of your items, which is typically when they depart your location. To have a valid claim, you must notify your movers of any damage you wish to report before they depart your location.
 

All claims must be submitted via email or by using our Damage Claim within 30 days of the conclusion of your move to be considered valid. If your claim is not filed within 30 days, it will be immediately void, and we will be unable to guarantee any damage reimbursement.

II. ADDITIONAL INSURANCE OPTIONS
As a labor-only moving company that does not provide transportation, we cannot provide additional coverage options. However, there are several types of insurance that may be available to you for your move:

  • Homeowners and Renters Insurance: This coverage typically covers damage that occurs during transit. We recommend that you speak with your insurer to confirm the details of coverage.

  • Third-Party Insurers: There are insurance companies that will sell a policy specifically to cover household goods during a move. These policies tend to have a lot of exclusions and should be thoroughly reviewed before purchasing.

  • Insurance from Truck Rental / Portable Storage Companies: Most truck rental, storage container, and transportation companies provide insurance options for your items. Review the details of each insurance option directly with your transportation company before purchasing.

     

III. WHAT IS NOT COVERED:
EXCLUSIONS We are not liable for any damages to the following items:

a. ANY ITEM NOT RECORDED ON OUR BOOKING FORM We cannot be liable for any damages to items that are not recorded on our booking form. You have the right to inspect all items prior to the departure of our crews. Any damaged items that are not excluded from coverage must be noted on the work order to be considered claimable.

b. ANY ITEMS TRANSPORTED BY A THIRD-PARTY Items that are transported by a third-party, PODS, or U-Pack agency are not covered.

c. ANY ITEMS NOT PACKED BY MOMENTUM MOVING & STORAGE Items packed by people who are not affiliated with Momentum Moving & Storage are not covered.

d. CHEAP & PARTICLE BOARD FURNITURE Generally, cheaper items, such as particleboard furniture, are prone to damage when moved. Although damage rarely happens, these items are not covered.

e. DAMAGE TO FURNITURE WHEN PROPER PADDING/BLANKETS WERE NOT PROVIDED Furniture pads are extremely important in ensuring that your items are packed safely for transport. If an adequate amount of pads are not provided by the customer during the load, we cannot be responsible for any damage that occurs.

IV. CLAIMS PROCESS

If you need to make a claim for damage that occurred during your move, please follow these steps:

  1. Notify The Company: You must notify The Company of any damages as soon as possible and before the movers depart your location. We recommend notifying the crew leader in writing, and making sure that you receive confirmation of the notification.

  2. Document the damage: Take photos of the damage and keep any damaged items and their packaging in case they need to be inspected.

  3. Submit a claim: You must submit a claim within 30 days of the conclusion of your move via email or by using our Damage Claim form, which can be found on our website. In your claim, please include the following information: a. Your name, phone number, and email address b. The date of your move c. The location of your move (origin and destination) d. A description of the damage and the items affected e. Photos of the damage f. An estimated cost of repair or replacement for each item

  4. Wait for a response: Once your claim has been received, The Company will investigate and respond within 30 days. If we require further information or need to inspect the damaged items, we will contact you to arrange this.

  5. Resolution: The Company will work to resolve your claim as quickly as possible. We may offer to repair or replace damaged items, or provide a monetary settlement. Any settlement offered will be based on the Released Valuation Coverage of up to $0.60 per pound, and will not exceed the amount you declared on your booking form.

Please note that failure to follow these steps and to provide all required information may result in a delay or denial of your claim. Also, any claim that is not filed within 30 days of the conclusion of your move will be immediately void, and we will be unable to guarantee any damage reimbursement.


By signing below, you acknowledge that you have read and fully understand the terms and conditions of this liability release, and you agree to release Momentum Moving & Storage from any and all claims for damages.


IV. CLAIM REMEDIES

If your furniture is damaged during a move, there are a few potential remedies that you can consider:

  1. Repair: If the damage is minor, it may be possible to repair the furniture. You can contact a professional furniture repair service to see if they can fix the damage.

  2. Replacement: If the damage is severe, it may not be possible to repair the furniture. In this case, you may need to consider replacing the damaged item.

  3. Compensation: You may be able to receive compensation from the moving company for the damage. This will depend on the terms of your moving contract and the specific circumstances of the damage.

  4. Refund: In some cases, you may be able to receive a refund for the cost of the move or a portion of the cost if the damage was severe or if the moving company was at fault.

  5. Insurance claim: If you have insurance that covers damage during a move, you may be able to file a claim and receive compensation for the damage.
     

It's important to review your moving contract and understand the terms and conditions of the moving company's liability for damages. If you have any questions or concerns, you should contact the moving company as soon as possible to discuss your options.
